We reserve the right to modify, suspend, or discontinue any Service or feature at any time with reasonable notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of Services.

Your Content: You retain ownership of any data, content, or materials you provide to us ("Client Data"). By submitting Client Data, you grant us a limited, non-exclusive, royalty-free license to use, process, and store your Client Data solely to provide and improve the Services.
AI-Generated Outputs: Content generated by our AI tools based on your inputs is provided for your use. You acknowledge that AI-generated content may not be eligible for copyright protection under U.S. law without significant human authorship. You are solely responsible for reviewing and verifying all AI-generated outputs before use.
No Training on Client Data: We do not use your confidential Client Data to train, fine-tune, or improve our AI models without your express written consent.
Fees for Services are as agreed upon in your service agreement or as displayed at checkout. All fees are in U.S. dollars unless otherwise stated. We reserve the right to change our pricing with 30 days' written notice to active clients.
For subscription-based Services, you authorize us to charge your payment method on a recurring basis on the agreed billing cycle. Failure to pay may result in suspension or termination of your account. You are responsible for all taxes applicable to your use of the Services.
Setup & One-Time Projects: You may request a full refund for any project or deliverable that has not yet been initiated or delivered. Once work has commenced or deliverables have been provided, refunds are issued at our sole discretion based on the proportion of work completed.
Monthly Subscriptions: Subscription fees are non-refundable for the current billing period upon cancellation. Your access will continue until the end of the paid period. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ZEPPELYNN AI LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZEPPELYNN AI LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Informal Resolution: Before filing any legal action, both parties agree to attempt to resolve disputes informally by contacting us at info@zeppelynn.com. We will make good-faith efforts to resolve the matter within 30 days.
Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
Class Action Waiver: YOU AND ZEPPELYNN AI LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Program Description: Zeppelynn AI provides automated SMS notifications for appointment reminders, service updates, and marketing communications.
Opt-Out & Help: You may cancel the SMS service at any time by texting "STOP" to the shortcode or number provided. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at info@zeppelynn.com.
Carrier Liability: Carriers are not liable for delayed or undelivered messages.
Rates & Frequency: As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
